MY Airbags Didn’t Go After in the Car Accident

If you were injured in a car accident and your airbag failed to deploy or deployed erroneously, Colorado law may entitle you to substantial compensation. Many Takata airbags have been recalled by the National Highway Traffic Safety Administration (NHTSA) due to faults that caused some airbags to burst when they inflated. According to the following, airbags produced by a second manufacturer were installed in 2010 to 2019 Toyotas, Hondas, Kias, Hyundais, Mitsubishis, Fiats, Chryslers, Dodges, and Jeeps NHTSA.

The National Highway Traffic Safety Administration (NHTSA) reported on April 19, 2019, that it is examining claims of defective airbags manufactured by ZF-TRW. This implies the NHTSA is one step closer to recalling millions of cars in the United States that have airbags manufactured by ZF-TRW. According to the release, the NHTSA will investigate if the ZF-TRW airbag control unit ACU, installed in about 12.3 million cars, might malfunction during an accident, preventing airbags and seat belt pre-tensioners from being deployed.

Our legal company is keeping a careful watch on whether the ZF-TRW ACUs will be recalled. Meanwhile, these cars and their ACUs are still on the road, posing a significant risk to drivers and passengers who depend on them in the event of an accident. Car accident victims who were wounded or killed due to an airbag that did not deploy or deployed erroneously require experienced legal counsel to defend their entitlement to compensation from airbag manufacturers. Look for a company with the resources and expertise necessary to investigate and prosecute even the most complex airbag malfunction cases. ABOUT OUR PRODUCT DEFECT AND MASS TORT PRACTICE

These cases include looking into and litigating broad Injury produced by a single accident or faulty product, such as when an oil spill destroys hundreds of miles of shoreline or a defective car component is put in millions of cars.

Warrior Car Accident Lawyers have obtained millions of dollars for individuals injured in various personal injury cases, including motor car accidents, throughout the years. Still, we are most proud of the accolades we get from our clients, who value our timeliness and attention to their specific requirements.

PROBLEMS WITH TAKATA AND ZF-TRW AIRBAGS

In a collision, airbags are meant to keep drivers and passengers safe. Unfortunately, since 2000, there have been growing concerns about whether these devices are putting the individuals they’re intended to safeguard at grave risk. Here’s a rundown of the problems with Takata and ZF-TRW airbag-related components.

SOME TAKATA AIRBAGS MAY EXPLODE WHEN THEY DEPLOY.

According to Consumer Reports, the NHTSA’s Takata airbag recall is the country’s biggest in history. It affects 41.6 million cars produced by 19 different automakers, mostly from 2002 to 2015.

The recall focuses on an airbag component known as an inflator, which is the device that inflates an airbag when triggered by a collision, as the name implies. The Takata inflators being recalled may occasionally explode, injuring or killing car passengers and sending shards of debris flying into the passenger compartment. At least 16 individuals have died due to these flaws in the United States, and more than 300 others have been wounded across the globe.

The Takata recall affects a large number of cars. Some Honda, Acura, Ford, and Mazda cars equipped with Alpha airbags offer such a high danger of explosive airbag activation that the National Highway Traffic Safety Administration (NHTSA) urges owners not to drive them until their airbag components are changed.

One of the most concerning parts of the Takata airbag recall is that many cars that have been subject to the recall have yet to be repaired and are still on the road with faulty Takata airbag inflators. According to Consumer Reports, a motorist who acquired a secondhand 2002 Honda Civic died due to an exploding Takata inflator last year. Unfixed cars under recall in South Colorado pose an especially high risk to drivers and passengers because, according to the National Highway Traffic Safety Administration, long-term exposure to high heat and humidity, such as that found in southern Colorado, increases the risk of a Takata airbag exploding.

We can assist clients in collecting damages following a Takata airbag failure at Warrior Car Accident Lawyers. Still, we hope that if you have a faulty airbag in your car, you get it corrected before you are wounded or worse. Whether you haven’t already done so, check to see if your car or one you’re considering purchasing is part of the Takata airbag recall and, if it is, have the issue remedied as soon as possible. The remedy will probably be inexpensive, and it might save your life.

Some ZF-TRW Airbag ACUs provide erroneous signals, preventing the airbag from deploying in the event of an accident.

The problem with ZF-TRW airbag ACUs is not the same as the one with Takata airbags. Takata airbag inflators may explode, but ZF-TRW airbags may not deploy at all if their ACUs fail to deliver the proper electrical signals to initiate deployment during an accident.

Although the NHTSA has not issued a recall for cars with ZF-TRW airbags in early June 2019, various auto manufacturers have issued their recalls. According to the Associated

Press, automakers Kia, Hyundai, and Fiat Chrysler have recalled ZF-TRW airbag-equipped cars without waiting for the NHTSA to announce a recall.

Anyone who owns a 2010-2019 Toyota, Honda, Kia, Hyundai, Mitsubishi, Fiat, Chrysler, Dodge, Jeep, or other Toyota, Honda, Kia, Hyundai, Mitsubishi, Fiat, Chrysler, Dodge, Jeep, or other Toyota, Honda, Kia, Hyundai, Mitsubishi, Fiat, Chrysler, Dodge, Jeep, or other Toyota, Honda, Kia, Hyundai, Mitsubishi, Fiat, Chrysler, Dodge, Jeep, or other Toyota, Honda, Kia, Hyundai, Mitsubishi, Fiat, Chrysler, If at all feasible, you should replace your ACU, even if it costs money. Keep all of your records so that you can prove your claim to compensation if a recall is issued and/or a legal settlement is reached.

HOW CAN WE ASSIST?

We strongly advise everyone reading this to take airbag faults seriously and get their car inspected to ensure it does not include any airbag components that have been proved or suspected to have flaws.

Unfortunately, we also know that there is no way to guarantee that every car with a faulty Takata airbag inflator or a possibly faulty ZF-TRW airbag ACU will be repaired. As a result, more individuals will be injured or killed in accidents involving these items. When an airbag- related catastrophe occurs, we may be able to assist the victims. Once we agree to take on a case, we can:

Look into the airbag malfunction to see whether it’s a known or suspected flaw or if it might indicate a previously undiscovered issue. Not every lawyer has the expertise to conduct such an inquiry, but we do. When required, we engage with automotive specialists to assess data and generate reports that explain how and why a specific airbag failed.

Assisting our clients in determining whether and how to pursue reimbursement from any existing settlement fund. Over the Takata airbag failures, victims have filed class- action lawsuits in which a few victims bring claims on behalf of a large class of people similarly situated to them, and manufacturers have set aside large pools of money to compensate car owners and others injured by an airbag failure for some car makes and models. However, not every Injury caused by an airbag qualifies for compensation under these class action settlements. Consult an attorney to learn how current settlements may influence your rights.

Negotiate and fight with car component manufacturers to get compensation for anybody injured due to a defective airbag system. This might happen as part of a class-action lawsuit or as an individual case, depending on the facts of your Injury.

This is only a sample of the legal services provided to victims of malfunctioning airbags by the Warrior Car Accident Lawyers team. These are complicated situations that demand the expertise and diligence that attorneys can only provide with our level of experience.

DAMAGES IN AIRBAG CASES THAT AREN’T WORKING

Victims of defective airbags may be entitled to substantial compensation. In many situations, the law makes manufacturers strictly accountable, which means that if a judge concludes that the product was unreasonably injuryful, they must compensate victims regardless of the

circumstances of the victim’s injuries. Those who have been injured by a product that fails to perform as intended under normal operating conditions may be able to recover damages to help pay for medical costs and long-term care; pain, suffering, and disfigurement; loss of income and ability to earn an income; and loss of life enjoyment and companionship.

Of course, there is no assurance that legal action would result in the victim receiving compensation. The result of any lawsuit is determined by the facts of the case, the relevant law, and the competence and expertise of the attorneys on both sides.

WHY DOES SKILLED LEGAL REPRESENTATION MATTER IN AIRBAG MALFUNCTION CASES?

In a case involving a defective airbag, victims cannot entrust their legal counsel to just any lawyer. Why? Because, unlike a typical personal injury case involving a two-car accident, airbag malfunctions are far from common. They’re complicated and sophisticated, and the opposing party is generally a large business with limitless resources to spend on defense attorneys and forensic specialists. Injured litigants need a legal company with the same firepower as the opposite side, one that is not hesitant to take on the most powerful opponents and battle for their right to compensation.

Victims also need a lawyer with a unique mix of abilities to maximize their claim against an airbag manufacturer. The lawyer must be sophisticated enough to grasp mass torts and product liability law and effectively argue complicated legal concepts before courts. At the same time, the lawyer must explain highly technical ideas to jury members who have no background in car mechanics if required. Warrior Car Accident Lawyers has that uncommon combination of skills.
